1.Acceptance of these Terms
These Terms & Conditions apply to all services provided by the Business. You agree to these Terms & Conditions by doing any of the following:
- requesting a quotation
- accepting a quotation
- booking an inspection
- booking an installation
- authorising work to be carried out
- paying a deposit
- paying an invoice
- allowing our workers to commence work at the Property

Where a signed or accepted quotation, proposal, Scope of Works, installation agreement or other separate written agreement exists, that document forms part of your agreement with us together with these Terms & Conditions.
If there is an inconsistency between documents, the signed or accepted quotation or Scope of Works will generally take precedence for that specific scope of work, subject to applicable law. Nothing in any document operates to exclude rights that cannot lawfully be excluded.

- An estimate may change if the actual site conditions differ materially from the information provided to us.
- A Quotation may specify an expiry date, after which it may need to be reviewed.
- Material prices, product availability, labour availability, access conditions and other circumstances may affect pricing.
- A Quotation covers only the work expressly listed in that Quotation.
- Anything not listed in the written scope is excluded unless separately agreed in writing.
Where a change in price or scope becomes necessary, we will discuss it with you and seek your agreement before performing additional chargeable work, except where clause 12 (urgent safety work) applies.
4.What a Quotation does not automatically include
Unless expressly stated in your Quotation or Scope of Works, our price does not include any of the following:
- removal of Existing Insulation
- disposal of Existing Insulation
- removal of rubbish not associated with the agreed work
- roof repairs
- ceiling repairs
- plasterboard repairs
- painting
- electrical repairs
- electrical relocation
- plumbing repairs
- air-conditioning repairs

- building-code upgrades outside the agreed scope
5.Acceptance of a Quotation
A Quotation is accepted when you:
- sign it
- accept it electronically
- pay a deposit
- confirm the booking
- instruct us in writing to proceed
- otherwise authorise commencement of the work
Acceptance confirms that you have had the opportunity to review the Scope of Works and that you understand what is included and what is excluded. If anything is unclear, please ask us before authorising work.
6.Inspections and their limitations
We may inspect the Property before commencing work. Any inspection we carry out is a visual, non-invasive assessment for the purpose of quoting and planning the Services, and it may be limited because:
- access may be restricted
- parts of the Roof Cavity may be inaccessible
- Existing Insulation may obscure the substrate
- lighting may be inadequate
- stored items may prevent inspection
- structural components may not be visible
- some hazards cannot be identified without destructive investigation
7.Your disclosure obligations
Insulation work takes place in ceilings, roof cavities, walls and subfloors, where problems are often concealed. Before work starts, you must tell us about any of the following that you know about, or reasonably suspect, at the Property:
- roof leaks
- water leaks
- previous flooding
- mould
- dampness
- condensation
- pest infestation
- termite activity
- asbestos or suspected asbestos
- electrical problems
- unsafe wiring
- solar equipment
- old wiring
- damaged ceilings
- sagging ceilings
- cracked plasterboard
- previous ceiling repairs
- previous insulation removal
- fire damage
- structural problems
- roof damage
- fragile roofing
- damaged access points
- other known hazards
- hazardous materials
- building defects
- previous renovations
Failure to disclose known issues may affect the scope, timing, safety and price of the work, and may require work to be stopped until the issue has been assessed by an appropriately qualified person. Where undisclosed conditions cause additional cost, we will discuss a Variation with you before performing additional chargeable work.
8.Pre-existing damage and building condition
Properties — particularly older properties — commonly contain damage or deterioration that existed before we attended. This can include:
- cracked plasterboard
- sagging ceilings
- loose ceiling sheets
- water-damaged plasterboard
- brittle plaster
- damaged cornices
- cracked joints
- previously patched areas
- deteriorated timber
- damaged roof timbers
- broken roof tiles
- damaged metal roofing
- damaged sarking
- degraded insulation
- vermin-damaged materials
- mould
- moisture damage
- corrosion
- brittle wiring
- unsecured electrical cables
- improperly installed electrical equipment
- previous workmanship defects
- unsealed penetrations
- damaged access hatches
- inadequate ceiling framing
- movement in the building
- structural defects
Installing or removing insulation requires our workers to move through or work around the Roof Cavity, Ceiling Space or subfloor. Even careful and reasonable access places some incidental load or movement on existing materials.
To the extent permitted by law, we are not responsible for damage that was:
- already present before we attended
- caused by deterioration or age
- caused by moisture
- caused by pests
- caused by structural movement
- caused by defective previous workmanship
- caused by the failure or work of another trade
- otherwise not caused by our negligence or breach of contract
9.Ceiling access and fragile ceilings
Safe ceiling and cavity access can be affected by:
- fragile plasterboard
- old plaster
- lath and plaster ceilings
- unsupported ceiling areas
- damaged framing
- restricted roof cavities
- low roof pitches
- narrow access points
- inaccessible sections
- ceiling-mounted fixtures
- ducting
- pipes
- wiring
- Existing Insulation
- stored objects
We will take reasonable care at all times. However, we cannot guarantee that an aged, damaged or defective ceiling will withstand the access reasonably required to perform the Services. Ceiling repairs are excluded unless specifically included in your Quotation.
If ceiling damage or an unsafe ceiling condition is identified before or during the work, we may:
- stop work in the affected area
- photograph and document the condition
- notify you as soon as reasonably practical
- recommend repair by an appropriately qualified trade
- revise the Scope of Works
- issue a Variation for your approval where appropriate
- resume work once the area has been made safe
10.Photographs, video and site records
We may take photographs and/or video of:
- the Work Area
- Existing Insulation
- ceiling condition
- Roof Cavity condition
- hazards
- defects and damaged materials
- electrical or plumbing installations
- access areas
- completed works
These records may be used to:
- document pre-existing conditions
- confirm the condition of an area before work commences
- document the work completed
- support quotations and variations
- assist in resolving any dispute
- maintain our business and compliance records
- demonstrate compliance with safety procedures
11.Asbestos and hazardous materials
We do not knowingly disturb, remove, cut, drill, break, handle or dispose of asbestos-containing materials unless we are appropriately licensed and expressly engaged to do so.
Asbestos-containing materials may be concealed within older properties — including in ceiling linings, eaves, backing boards, flues, wall sheeting and around services — and may not be visually identifiable during a standard insulation inspection.
If asbestos or suspected asbestos is identified:
- work may stop immediately
- the affected area will be left undisturbed
- you will be informed as soon as reasonably practical
- specialist sampling and testing may be recommended
- an appropriately licensed asbestos professional may need to assess or remove the material
- additional costs and delays may apply, to the extent permitted by law and subject to your agreement to any Variation
Similar precautions apply to other hazardous or contaminated materials, including:
- mould
- contaminated insulation
- animal waste
- chemicals
- pest-contaminated material
- sharp objects
- unsafe wiring
- biological hazards
12.Electrical, plumbing and concealed services
Roof cavities, wall cavities and subfloors commonly contain:
- electrical cables
- junction boxes
- transformers
- downlights
- sensors and detectors
- solar-related equipment
- communication and data cables
- alarm systems
- HVAC wiring
- plumbing
- gas lines and other services where relevant
We will take reasonable care around visible services and will maintain required clearances around fittings where they are identifiable. However, we cannot guarantee the location, condition, adequacy or compliance of concealed services installed by others before our attendance.
We do not perform electrical work unless we are specifically licensed and contracted to do so. Where unsafe electrical conditions are identified, work may be paused in that area until a licensed electrician has made the area safe.
13.Roofing, leaks and weatherproofing
We are an insulation installer, not a roofing contractor, unless roofing services are expressly included in your Scope of Works. We are not automatically responsible for the weatherproof condition of the roof, including:
- roof leaks
- broken or cracked tiles
- rusted roofing
- deteriorated flashing
- failed seals
- damaged valleys
- roof penetrations
- condensation
- inadequate ventilation
- damaged sarking
- pre-existing water ingress
Insulation does not repair or prevent existing roof leaks, condensation or moisture problems. We do not guarantee that installing insulation will correct roof leaks, mould, condensation, structural problems or ventilation defects. Where we identify a roofing issue, we will let you know and may recommend assessment by an appropriately qualified roofing contractor.
14.Moisture, mould, condensation and ventilation
Insulation interacts with the existing construction, ventilation and moisture conditions of a building. If moisture, mould, dampness, condensation or water ingress is identified, we may recommend that the underlying cause be resolved before insulation is installed.
Insulation should not be installed over materially wet or contaminated materials where doing so would be unsafe, ineffective or otherwise inappropriate. In those circumstances we may pause the work in the affected area and discuss options with you.
We do not warrant that installation will eliminate pre-existing moisture or condensation problems unless that specific outcome is expressly included in the Scope of Works.
15.Existing insulation: retention, removal and disposal
Existing Insulation may contain:
- dust
- dirt
- mould
- pests
- faeces
- urine
- degraded fibres
- other contaminants
- unknown or unidentified materials
A. Installing over Existing Insulation
New insulation is installed above or alongside the Existing Insulation, which remains in place. This is only appropriate where the Existing Insulation is dry, uncontaminated and technically suitable to remain.
B. Removing Existing Insulation
The Existing Insulation is extracted, bagged and taken off site for lawful disposal. This is additional work and is only included where your Quotation expressly says so.
Removal and disposal are only included where expressly stated in your Quotation. Where removal is not included, we may leave the Existing Insulation in place where it is safe and technically appropriate to do so. If Existing Insulation is found to be unsafe, contaminated, wet, damaged or otherwise unsuitable, additional work may be required and we will discuss a Variation with you.
16.Pests, vermin and biological contamination
Ceiling and subfloor spaces may contain evidence of:
- rodents
- birds
- possums
- bats
- insects
- termites
- nests
- droppings
- urine
- carcasses
- contaminated insulation
Pest control, wildlife removal, proofing and biological remediation are outside our normal insulation scope unless expressly included in your Quotation. Where contamination presents a health or safety concern, we may pause the work and recommend that an appropriately qualified specialist attend before we continue.
17.Site access and customer preparation
You must provide safe, clear and lawful access to the Property and the Work Area. Please:
- remove stored items near the access area
- provide access to the Roof Cavity, wall areas or subfloor as relevant
- unlock gates and doors where necessary
- advise us of any pets
- advise us of alarms and security systems
- identify important, valuable or fragile property
- ensure the agreed Work Area is reasonably accessible on the booked day
Where the agreed access is not available on the booked day, additional attendance, waiting or labour costs may apply, subject to applicable law and the pricing agreed with you. We will always try to reschedule co-operatively before charging any additional amount.
You must keep children, pets and unauthorised persons away from the active Work Area. To the extent permitted by law, we are not responsible for injury or loss resulting from a person entering an active Work Area contrary to reasonable safety instructions. Nothing in this clause limits liability that cannot lawfully be excluded.
18.Unsafe sites and suspension of work
We have work health and safety obligations to our workers. We may decline to commence, or may suspend, work where we reasonably consider the site or an area of it to be unsafe. Examples include:
- unsafe roof access
- unstable or fragile ceilings
- exposed electrical hazards
- asbestos concerns
- severe pest contamination
- dangerous structural conditions
- excessive heat in a roof cavity
- inadequate access
- hazardous materials
- unsafe working-at-heights conditions
Work may remain suspended in the affected area until the hazard has been addressed. We will explain the issue to you and, where we can, suggest what is required to make the area safe.
19.Coverage limits and inaccessible areas
Insulation coverage may be physically limited by matters such as:
- roof design
- low roof pitch
- small access hatch
- framing
- ductwork
- plumbing
- electrical equipment
- structural barriers
- sections with no practical access
We will not be required to enter or work in an area that is unsafe or that cannot be reached without damage or dismantling. Inaccessible areas may remain uninsulated. Where reasonably practical, we will identify these areas to you and note them in your completion documentation.
20.Products, specifications and substitutions
Installation is limited to the products, locations and quantities agreed in your Scope of Works, which will record:
- insulation type
- R-value
- thickness
- manufacturer
- product specification
- areas covered
- quantity
- installation method
Substitutions will only be made with your approval, except where a replacement is necessary and legally permissible and the replacement product is of equivalent or otherwise suitable specification. Delays or substitutions may arise due to manufacturer shortages, discontinued products, supplier delays, transport delays, weather or unexpected site conditions.
Where a specified product becomes unavailable, we will contact you, explain the position, and propose a suitable alternative (including any price difference) for your agreement before proceeding.
21.Variations and additional work
Additional work or a change in price may be required where:
- actual measurements differ from those quoted
- access differs from what was described
- Existing Insulation requires removal
- contaminated material is discovered
- asbestos is suspected
- ceiling damage is discovered
- the site is unsafe
- additional preparation is required
- unexpected structural conditions are found
- you request additional work
- additional materials are requested
- areas outside the original scope are added
Where practical, all Variations must be approved by you — in writing, by email, or by another clear recorded confirmation — before additional chargeable work is performed. You will not be charged for unapproved additional work except where clause below applies.
22.Scheduling, timeframes and delays
Booking dates and durations are estimates unless a fixed date has been expressly agreed in writing. Delays may occur due to:
- weather
- supplier delays
- product availability
- illness
- safety concerns
- site access
- hidden site conditions
- customer delays
- other contractors on site
- government restrictions
- events outside our reasonable control
Where no fixed timeframe has been agreed, we will supply the Services within a reasonable time, consistent with the Australian Consumer Law. We will keep you informed of any material change to your booking.
23.Payment terms
- Deposit: as stated in your Quotation (where a deposit applies)
- Progress payments: as stated in your Quotation for staged or larger works
- Final payment: due on Completion unless your Quotation states otherwise
- Payment methods: bank transfer, or card and cash by prior arrangement
- Payment due date: within 7 days of the invoice date unless otherwise agreed in writing
Invoices must be paid by the stated due date. Undisputed amounts must be paid on time. If you believe an invoice is incorrect, please raise it with us promptly and in good faith so it can be reviewed — we will work with you to resolve genuine invoice disputes.
Deposits and payments are handled subject to applicable law. Nothing in this clause removes or limits your statutory rights, including your rights under the Australian Consumer Law.
Late payment. Where an undisputed invoice remains unpaid after the due date, we may charge interest at a reasonable rate disclosed to you in writing, and/or recover reasonable costs actually incurred in recovering the debt, but only where lawful and only where clearly disclosed to you in advance. We do not charge punitive or excessive fees.
24.Cancellation and rescheduling
If you need to cancel or reschedule, please contact us as early as possible. Where legally permitted, we may recover reasonable costs we have actually incurred, such as:
- specially ordered or custom materials
- supplier cancellation fees
- labour already performed
- reasonable travel and attendance costs
- other non-refundable costs already committed
Deposits are not automatically forfeited. Where we have not incurred costs, or our costs are less than the deposit paid, the balance will be refunded. Any statutory cooling-off or cancellation rights that apply to your agreement continue to apply.
Failed or aborted attendance. Where we attend as booked but cannot start or complete the work because nobody is present when attendance is required, access or keys are unavailable, pets prevent access, the Work Area has not been prepared, unsafe conditions prevent work, we are asked to leave, or another contractor prevents access, we will contact you to reschedule. Reasonable attendance costs actually incurred may apply where lawful and where we have disclosed them in advance.
25.Insulation performance and energy savings
Insulation performance in a real building depends on many factors, including:
- building design
- roof construction
- existing insulation
- ventilation
- air leakage
- windows
- doors
- wall construction
- ceiling construction
- heating and cooling systems
- local climate
- workmanship by other trades
- occupant behaviour
Any energy-saving figures, comfort improvements or performance indications we provide are estimates only unless expressly stated otherwise in writing. Actual savings depend on your circumstances, including energy usage, weather, building design and existing insulation. We do not guarantee a particular reduction in energy bills or a specific indoor temperature unless the Scope of Works expressly includes an engineering assessment on which such a result can reasonably be based.
26.Warranties
Manufacturer warranties. Insulation products carry the manufacturer's own warranty and are subject to the manufacturer's terms, conditions and claim procedures. Where available, we will pass on product warranty documentation to you.
Workmanship warranty. We warrant our installation workmanship for 5 years from Completion. This warranty is in addition to, and does not limit, the consumer guarantees you have under the Australian Consumer Law.
Our workmanship warranty does not cover damage or loss caused by:
- work performed by other trades
- structural movement
- roof, plumbing or other leaks
- pests or vermin
- later alterations to the building
- misuse or unauthorised removal or disturbance of the insulation
- storage of items on top of installed insulation
- events outside our reasonable control
Making a claim. Contact us using the details on this page with your invoice or quote number, the Property address, a description of the issue, photographs where relevant, and the date you identified the problem. We will respond and, where appropriate, arrange an inspection.
27.Your rights under the Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts or modifies any right, remedy, guarantee, condition or warranty that cannot lawfully be excluded, restricted or modified under Australian law, including the Australian Consumer Law. If any part of these Terms would have that effect, it is to be read down to the extent necessary, or severed, so that it does not.
Consumer guarantees notice
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- • to cancel your service contract with us; and
- • to a refund for the unused portion, or to compensation for its reduced value
You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
28.Limitation of liability
To the extent permitted by law, and subject always to the clause above regarding your Australian Consumer Law rights, we are not liable for loss or damage caused by:
- pre-existing damage
- structural defects
- concealed defects
- unsafe existing conditions
- defective work performed by other contractors
- undisclosed hazards
- pest infestation
- asbestos present at the Property
- water leaks
- roof defects
- your instructions where we have advised against them
- unauthorised modifications to our work
- failure to disclose material information
29.Damage caused during the works
We take reasonable care to avoid damage to your Property. Where we cause damage through negligence, improper workmanship or other actionable conduct, we will address the matter in accordance with our legal obligations — including by repairing or arranging repair of the damage, or otherwise providing an appropriate remedy.
Where damage arises from pre-existing deterioration, hidden defects, or materials that cannot safely withstand normal and careful access, the limitations described in the clauses on pre-existing damage and ceiling access apply, to the extent permitted by law.
Please report any damage to us promptly so we can inspect it while the circumstances can still be assessed.
30.Clean-up and waste
Standard clean-up included in the Services means:
- removal of normal installation waste generated by us
- removal of our packaging and offcuts
- leaving accessible areas of the Work Area reasonably tidy
Unless expressly agreed, we are not responsible for removing:
- pre-existing rubbish
- unrelated construction waste
- Existing Insulation (unless removal was included)
- hazardous waste
- pest-contaminated material
- asbestos or suspected asbestos material
- materials belonging to other contractors
Please move fragile or valuable belongings away from areas where our workers need to operate. We will take reasonable care, but to the extent permitted by law we are not responsible for damage to items knowingly left in an unsafe, obstructive or inaccessible location.
31.Other trades and subcontractors
We are not responsible for work performed by others, including:
- electricians
- roofers
- builders
- plasterers
- pest controllers
- asbestos contractors
- plumbers
- HVAC contractors
- other trades engaged by you
We may recommend other trades as a courtesy. Unless we have separately contracted to manage or perform that work, they are engaged directly by you and we do not accept responsibility for their work.
We may engage appropriately qualified and insured subcontractors to perform part of the Services. We remain responsible for the Services we have contracted to provide to you, to the extent required by law.
32.Customer-directed methods and materials
If you ask us to use a particular product, method, thickness or approach, that request may affect the suitability, performance, compliance or warranty of the installation. We will tell you where we have concerns.
Where you request work that we reasonably consider unsafe, unsuitable, non-compliant or contrary to manufacturer requirements, we may decline that request or ask you to confirm your instruction in writing.
Title to materials supplied by us passes to you on full payment for those materials. Risk in installed materials passes on installation. These provisions operate subject to applicable law and do not override your consumer rights.
33.Approvals, compliance and property type
You must tell us about any known:
- heritage requirements
- strata requirements
- body corporate rules
- landlord requirements
- council requirements
- building restrictions
- access restrictions
Unless we have expressly agreed in writing to obtain a particular approval on your behalf, obtaining all necessary approvals, permissions and consents is your responsibility. We do not represent that the Services comply with a particular building code, Australian Standard or government requirement unless we have expressly stated that in writing and verified it.
34.Events outside reasonable control
Neither party is responsible for delay or failure to perform caused by an event outside its reasonable control, including:
- severe weather
- natural disasters
- fire
- flood
- epidemic or pandemic
- government action
- industrial disruption
- supplier failure
- transport disruption
- unexpected site hazards
Where such an event occurs, we will contact you to reschedule the Services within a reasonable time. Your rights under the Australian Consumer Law, including in relation to unreasonable delay, continue to apply.
35.Complaints and defect rectification
If something isn't right, please contact us first so we can look into it:
- by email: reception@thermotechinsulation.com.au
- by phone: 0490 339 808
- or via our contact form at thermotechinsulation.com.au/contact
To help us investigate quickly, please provide:
- your invoice or quote number
- the Property address
- a description of the issue
- photographs where relevant
- the date you identified the problem
We will investigate complaints fairly and promptly, and will keep you informed of the outcome. Where a legitimate defect in the Services is identified, we may inspect and, where appropriate, rectify the issue.
36.Termination
Either party may terminate the agreement, subject to applicable law, in circumstances including:
- serious or unremedied breach by the other party
- unsafe site conditions that cannot reasonably be resolved
- an ongoing inability to obtain access to the Work Area
- non-payment of undisputed amounts
- material misrepresentation, including non-disclosure of known hazards
- cancellation agreed between the parties
On termination, you remain liable for work properly performed and materials properly supplied up to the date of termination, together with reasonable costs actually incurred and not able to be recovered. Any amount you have paid in excess of that will be refunded. Your statutory rights are unaffected.
37.Privacy
We collect and handle personal information in accordance with applicable Australian privacy laws. You can request a copy of our privacy practices at any time by contacting us on 0490 339 808 or reception@thermotechinsulation.com.au.
38.Website content and intellectual property
Information on our website — including product descriptions, images, pricing, insulation information, R-value information, energy-saving estimates and installation examples — is general information only. It does not form part of your agreement unless it is expressly incorporated into your accepted Quotation or Scope of Works.
Logos, photographs, graphics, text, branding, videos and other original content on this website belong to the Business or its licensors unless otherwise stated. You may view and share our content for personal, non-commercial purposes, but you may not reproduce, adapt or republish it for commercial purposes without our written permission.
Our website may contain links to third-party websites. We do not control those websites and are not responsible for their content, products or practices.
39.Changes to these Terms
We may update these Terms & Conditions from time to time for future quotations, bookings and orders. The version that applies to your work is the version in effect when your Quotation was accepted.
Changes will not retrospectively alter an already accepted contract unless the change is agreed between us or is otherwise permitted by law.
40.General provisions
Severability. If any provision of these Terms is invalid or unenforceable, that provision is read down or severed to the minimum extent necessary, and the remaining provisions continue to operate to the extent permitted by law.
Waiver. A failure or delay in enforcing a provision does not, of itself, waive that provision or any other right, subject to applicable law.
Governing law. These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts and tribunals. This does not limit any mandatory consumer protection or jurisdictional right available to you elsewhere in Australia.
Entire agreement. These Terms operate together with your accepted Quotation, Scope of Works, written Variations, invoices, warranty documentation and any separate written agreement. The written scope defines the specific Services you are purchasing.
41.Customer acknowledgement checklist
Before authorising work, please confirm the following. This checklist is also used on our quotation and booking documents.
- I have disclosed any known roof leaks.
- I have disclosed any known ceiling damage.
- I have disclosed any known water or moisture issues.
- I have disclosed any known mould.
- I have disclosed any known pest infestation.
- I have disclosed any known asbestos or suspected asbestos.
- I have disclosed any known electrical issues.
- I understand that concealed conditions may exist.
- I understand that old or fragile ceilings may be susceptible to damage during reasonable access.
- I understand whether existing insulation is being removed or retained.
- I understand what is included in the quotation.
- I understand what is excluded from the quotation.
- I understand that additional work may require a variation.
- I understand that inaccessible areas may not be able to be insulated.
- I have provided safe and reasonable access to the work area.
If you are unsure about any item above, please ask us before work commences. Raising a concern early is almost always cheaper and safer than discovering it mid-installation.
